Ratio Decidendi

The court found that the applicant had fulfilled all legal requirements for adoption under the Children Act. The child was abandoned at birth, and despite reasonable efforts, the natural mother could not be traced. The applicant had cared for the child since infancy, and all reports from the Child Welfare Society, Director of Children’s Services, and the guardian ad litem were favorable. The court held that dispensing with the natural mother’s consent was justified and that the adoption was in the best interest of the child. Accordingly, the applicant was authorized to adopt the infant, who would henceforth be known as J W K, and a birth certificate would be issued in the new name.
