Ratio Decidendi

The court found that the applicant satisfied all statutory requirements for adoption under the Children’s Act, 2022. The child was abandoned at birth, declared free for adoption, and placed with the applicant, who is financially and mentally fit, with no criminal record. The applicant and child have bonded, and all reports recommend the adoption. The court held that the adoption serves the best interests of the child, who is presumed a Kenyan citizen by birth under Article 14(4) of the Constitution. The court therefore authorized the adoption, directed the child’s registration and issuance of a passport, and appointed legal guardians in the event of the applicant’s incapacity or death.
