Procedural Posture

Succession Cause / Ruling on Application to Declare Subdivision Null and Void and for Involvement in Subdivision Process

  1. 1 Whether the subdivision of Muguga/Gitaru/54 should be declared null and void for lack of involvement of the applicants.
  2. 2 Whether the applicants are entitled to be involved in the subdivision process of the estate property.

Ratio Decidendi

The court found that the previous order by Karanja J required both applicants and respondents to jointly participate in the demarcation and transfer of the estate property. The evidence showed that the applicants were excluded from the process, contrary to the court's directive. The respondent's reliance on res judicata was rejected because the issue at hand was non-compliance with a specific court order, not a re-litigation of previously determined matters. The court therefore allowed the application, ordered compliance with the earlier order within 60 days, and directed that the matter be mentioned for compliance thereafter. Costs were awarded to the applicants.
