Ratio Decidendi

The court found, based on uncontroverted affidavits from the Petitioners, a sibling, the area Assistant Chief, and a consultant psychiatrist, as well as its own observation of the Subject in court, that KG is profoundly mentally and physically incapacitated from birth. He is incapable of managing his own affairs and will require lifelong care. The court held that the requirements of sections 26 and 28 of the Mental Health Act, Cap. 248, were satisfied. The appointment of the Petitioners as guardians and managers of the Subject's estate is necessary to protect his interests, especially as he is due to inherit property. The court therefore granted the orders sought in the petition.
