The respondent's arguments regarding non-compliance with the Auctioneers Rules and lack of proof of payment were not sustainable in the present application, as the proper forum for challenging the sale process was in the application to set aside the sale, which had already been dismissed and was under appeal. The issuance of the certificate of sale by the court was sufficient evidence of compliance with the requirements for confirmation and vesting. Therefore, the application for confirmation of sale and vesting order was allowed.
