Legal Issues
- 1 Whether the applicants have met the legal requirements for adoption under the Children’s Act.
- 2 Whether the consent of the biological mother can be dispensed with due to abandonment.
- 3 Whether the adoption is in the best interests of the child.
Ratio Decidendi
The court found that the applicants had satisfied all statutory prerequisites for adoption under the Children’s Act, including age, marital status, financial stability, and good character. The child, having been abandoned and with all efforts to trace the biological mother unsuccessful, was eligible for adoption without parental consent. Reports from the Guardian Ad Litem and the Director of Children’s Services confirmed the applicants’ suitability and the child’s need for a permanent family. The court determined that the adoption would be in the best interests of the child, granting the orders sought, including the change of name and appointment of legal guardians.
