Legal Issues
- 1 Whether Meshack Maira Obudho can be presumed dead under Section 118A of the Evidence Act.
- 2 Whether sufficient evidence exists to support the presumption of death after seven years of disappearance.
Ratio Decidendi
The court found that Meshack Maira Obudho had not been heard from for over twelve years by those who would be expected to have heard from him if he were alive. The disappearance was reported to the police, and all reasonable efforts to trace him had failed. Applying Section 118A of the Evidence Act, the court held that the statutory threshold for presumption of death had been met. Therefore, a rebuttable presumption of death was made, enabling the applicant to proceed with succession matters.
