The court found, based on uncontroverted medical evidence and supporting affidavits, that MWN suffers from a mental disorder (depressive illness) rendering her incapable of managing her own affairs. The applicant, RWN, is the biological daughter and primary caregiver of MWN, and her suitability is supported by the consent of all siblings and the absence of any objection. The court was satisfied that the requirements of Section 26 of the Mental Health Act were met, and that appointing RWN as guardian and manager would serve the best interests and welfare of MWN. Accordingly, the application was allowed, and RWN was appointed as legal guardian and manager of MWN's estate.
