The court held that advocate-client costs incurred by an advocate acting for a liquidator in winding up proceedings are not ordinary company debts that must await distribution with other creditors. Instead, such costs are a special category (sui generis) and, once taxed and where funds are available, should be paid forthwith. The court found that the applicant's bill of costs had been taxed, funds were available, and there was no legal impediment to immediate payment. The breakdown in the advocate-client relationship further justified granting leave for the advocate to cease acting. The application was therefore meritorious and allowed in full.
