The document presented by the applicant was a private deed, not a court order, and therefore did not satisfy the statutory requirements for recognition. As such, the application was incompetent and could not be granted. The court emphasized that only court-issued adoption orders from Commonwealth jurisdictions are acceptable for registration and recognition in Kenya.
