Ratio Decidendi

The court found that the evidence presented in the affidavits of the applicant and Johnson Kuria Mungai established that Eliud Mungai Mbure disappeared in 2006 and has not been heard from by any person who would be expected to have heard from him if he were alive. As more than seven years have elapsed since his disappearance, the statutory requirements under section 118A of the Evidence Act were met. The court was satisfied that the presumption of death should be made in accordance with the law.
