Miscellaneous Application / Ruling on Petition for Guardianship and Management of Estate

  1. 1 Whether MWM is a person suffering from a mental disorder within the meaning of the Mental Health Act, Cap 248.
  2. 2 Whether the petitioners should be appointed as guardians and managers of MWM's estate under Sections 26 and 28 of the Mental Health Act.

Ratio Decidendi

The court found, based on uncontroverted medical evidence and supporting affidavits, that MWM suffers from Alzheimer’s disease and is incapable of managing her own affairs. The petitioners, her children, were properly identified and supported by all siblings and the area chief. The court held that the requirements of Sections 26 and 28 of the Mental Health Act were satisfied, warranting the appointment of the petitioners as both guardians and managers of MWM’s estate. The court further directed compliance with Section 33 regarding inventory and annual accounts, and ordered service of the order on the Public Trustee. The application was thus merited and granted as prayed.
