Adoption Cause / Judgment

  1. 1 Whether the applicant, a sole female, should be authorized to adopt a male child in light of the Children Act and National Adoption Committee guidelines.
  2. 2 Whether the applicant is fit and suitable to adopt the child OMN alias MK.
  3. 3 Whether the adoption is in the best interests of the child.

Ratio Decidendi

The court found that the applicant, HCK, satisfied the special circumstances required for a sole female to adopt a male child, as she has a biological child and no other person has come forward to adopt OMN alias MK. The applicant demonstrated fitness and capacity to provide for the child, as evidenced by positive reports from the Guardian ad Litem and the Children Officer. The adoption was deemed to be in the best interests of the child, who had been abandoned and had bonded well with the applicant. The court therefore authorized the adoption, renamed the child, and appointed legal guardians in the event of misfortune befalling the applicant.

Court Disposition

Adoption granted.
