The court found that the petitioner was unable to pay his debts, with liabilities significantly exceeding assets. However, the rights of secured creditors, established through valid charges over specific properties, take precedence and are not affected by the bankruptcy petition. The court held that the Official Receiver should be appointed as trustee over the remaining assets for the benefit of unsecured creditors, but the secured creditors are entitled to exercise their statutory power of sale over the charged properties. The bankruptcy petition was therefore partly allowed in respect of unsecured creditors, but denied as to the secured creditors' interests in the charged properties....
