The court found, based on medical evidence and direct observation, that SK suffers from a mental disorder rendering him incapable of managing his affairs. The applicants, being SK's immediate family (brother and mother), were found to be fit and proper persons to be appointed as guardians. The court was satisfied that their appointment would serve the best interests and welfare of SK, in accordance with the Mental Health Act. Consequently, the court declared SK incapable of managing his affairs and appointed GK and RCK as his guardians, with liberty for SK to apply should his mental status change.
