The court found, based on the medical evidence and its own observation of SWK, that she suffers from dementia and lacks the capacity to manage her own affairs. The court noted that all of SWK's children, including the petitioner's siblings, consented to the appointment of SK as guardian. The requirements of Section 26 of the Mental Health Act were satisfied, as SWK was found to be suffering from a mental disorder to such an extent as to be incapable of managing her estate. The court was satisfied that SK was a suitable person to be appointed as guardian and manager of SWK's affairs, and accordingly granted the orders sought in the petition.
