Ratio Decidendi

The court held that, in accordance with Rule 81(4) of the English Civil Procedure Rules as adopted in Kenya and the Court of Appeal decision in Christine Wangari Gachege v Elizabeth Wanjiru Evans & 11 Others, leave is not required to institute contempt proceedings for breach of a court order. The application for leave was therefore unnecessary. The applicant is at liberty to file substantive contempt proceedings without seeking leave. The court also noted that each party should bear its own costs, as the application was not warranted under the law.
