Ratio Decidendi

The court held that the Law of Succession Act does not expressly provide for substitution of personal representatives who die in office. Section 81 of the Act only allows surviving administrators to continue with their duties; it does not permit substitution of a deceased administrator with another person. Where all administrators have died, the grant becomes inoperative and must be revoked to allow for the appointment of new administrators under sections 51 to 66 of the Act. Since there was still a surviving administrator in this case, substitution was not permissible. The application for substitution was therefore dismissed as untenable in law.
