Succession Cause / Ruling on Application for Letters of Administration Ad Litem
Legal Issues
- 1 Whether the applicant is entitled to letters of administration ad litem for the purpose of claiming life insurance proceeds without instituting a suit.
- 2 Whether letters of administration ad litem can be granted where no suit is intended to be filed.
Ratio Decidendi
The court held that letters of administration ad litem are specifically intended for persons seeking to file suits on behalf of a deceased person's estate. Since the applicant expressly stated she did not intend to file any suit, her application did not meet the legal threshold for the grant of such letters. The proper procedure for the applicant is to apply for letters of administration in the normal manner, not ad litem. Consequently, the application was found to be incompetent and was struck out.
Court Disposition
application struck out
Orders
- The application for letters of administration ad litem is struck out.
