The court found that the Applicant, a widow of the deceased, was not involved in the process of obtaining the grant of letters of administration nor in the confirmation and subdivision of the deceased's estate. The administrators, being the deceased's brothers, obtained the deceased's identity card and title deed without the widow's knowledge or consent and failed to serve her with the necessary citations or involve her in the proceedings. The grant was therefore obtained in contravention of Section 76 and Section 66 of the Law of Succession Act, as well as the Probate and Administration Rules, which require the participation and consent of all beneficiaries.
