Ratio Decidendi

The High Court lacked jurisdiction to entertain succession causes relating to the estate of a deceased Muslim by virtue of Section 2(3) of the Law of Succession Act. Neither petitioner had been lawfully issued with a grant of letters of administration, as evidenced by the absence of an original grant in the court record and the lack of supporting documents. The existence of two separate succession causes for the same estate, both riddled with anomalies and procedural defects, amounted to an abuse of the court process. Accordingly, both causes were struck out, and any further proceedings regarding the estate must be instituted before the Kadhi’s Court.

Court Disposition

Both succession causes struck out for want of jurisdiction and abuse of process.

Orders

  • Succession Cause No. 28 of 2008 and Succession Cause No. 2 of 2012 are struck out.
