Ratio Decidendi

The court found that Mohammad Shaaban, as a nephew to the deceased's wife and not a blood relative of the deceased, did not rank in preference to the applicant, who was a grandson of the deceased. According to section 66 of the Law of Succession Act, grandchildren of the deceased have a higher priority than a nephew of the deceased's spouse. The administrator was required by Rule 7(7) of the Probate and Administration Rules to ensure that all persons with prior entitlement had either renounced their right, consented in writing, or been cited before applying for the grant.
