SUCCESSION CAUSE NO. 881 OF 2013
IN THE MATTER OF THE ESTATE OF JOSEPH MUCHIRI MUTERU – (DECEASED)
RULING
1. The grant herein was confirmed on 10th March 2014. The property making up the estate, that is to say Plot No. 119 Umoja II Zone 8 was to be sold and the proceeds from the sale invested for the benefit of the minor children of the deceased.
2. The property was sold and the money realised in sale has been deposited in court. The administrators have asked me to grant directions on the distribution of money among the beneficiaries.
3. It was ordered on confirmation that the property be sold and its proceeds invested. Consequently, the money shall be dealt with in terms of the certificate of confirmation of grant dated 10th March 2014.
4. I hereby direct that the said money be deposited in an interest earning bank account in the names of the administrators for the benefit of the children. The funds shall be withdrawn only on the strength of a court order, obtained for the specified and justified needs of the children.
5. Mention on 20th January 2015 for compliance.
