Ratio Decidendi

The court found that the document dated 6th September 1991 did not constitute a valid will as defined by the Law of Succession Act. The document was not a declaration by the deceased of his wishes regarding the disposition of his property after death, but rather a record of an actual subdivision of property that took place during the deceased's lifetime. The document was not futuristic and did not express any intentions to be carried out after death. Consequently, the deceased was deemed to have died intestate, and the process of obtaining the grant in Kiambu RMCSC No. 101 of 2009 was neither fraudulent nor defective. The application for revocation of the grant was therefore dismissed.
