Ratio Decidendi

The court held that since a grant of probate of written will had already been issued in respect of the deceased's estate after proper gazettement and no objection, it is impermissible to have a second grant in respect of the same estate. The petition by Richard Momanyi O. Emmanuel was therefore misplaced and superfluous. Any claim by Richard Momanyi O. Emmanuel should be raised in the existing succession cause where the grant was issued. Allowing a second petition would create confusion and is contrary to the law governing succession and probate. The court accordingly struck out the petition with costs to the applicants.
