While Kikuyu customary law is patrilineal and generally excludes daughters from inheritance, the court held that customary law must not be repugnant to justice and morality or inconsistent with written law. The respondent failed to adduce expert evidence to establish the exclusion of the applicant under Kikuyu custom.
