Procedural Posture

Succession Cause / Ruling on Application to Set Aside Previous Dismissal Order

  1. 1 Whether the order made on 28th November 2014 dismissing the application dated 31st January 2003 for want of prosecution was valid.
  2. 2 Whether the application dated 31st January 2003 had already been determined by Koome J. on 8th October 2003, rendering it unavailable for dismissal.
  3. 3 Whether the court should set aside the order made on 28th November 2014 and uphold the orders made on 8th October 2003.

Ratio Decidendi

The court found that the application dated 31st January 2003 had already been determined and allowed by Koome J. on 8th October 2003, as evidenced by the extracted formal order and the agreement of both parties. Therefore, the subsequent order of 28th November 2014, which purported to dismiss the same application for want of prosecution, was made in error. The court held that there was nothing left to dismiss, and the order of 28th November 2014 ought not to have been made. Consequently, the court set aside the order of 28th November 2014 and upheld the orders made on 8th October 2003.

Court Disposition

Application allowed; previous dismissal order set aside; prior grant revocation order upheld; matter transferred to Murang'a High Court; costs to applicants.
