Ratio Decidendi

The court held that although the deceased died before the commencement of the Law of Succession Act, the Constitution of Kenya 2010, which guarantees equality and non-discrimination, overrides any customary law that would exclude daughters from inheriting. The estate, being registered land, must be distributed in accordance with the law under which it was registered and the Constitution. The proposal by the first administrator, which allocates a share to each daughter, is consistent with constitutional principles and is therefore adopted.
