Succession Cause / Ruling on Confirmation of Grant and Protest

  1. 1 Whether the objector, Joel Kiragu Gatune, is entitled to a share of Land Parcel No. Loc.19/Rwathia/912 as part of the deceased's estate.
  2. 2 Whether the arbitral award and subsequent court judgment awarding 1/3 of the suit land to the objector are binding on the estate and the petitioners.
  3. 3 Whether the petitioners are entitled to the entire suit land or only to the portion not already awarded to others by prior proceedings.

Ratio Decidendi

The court found that the arbitral award made by the Kangema elders, adopted as a judgment by the Murang'a Resident Magistrate's Court in 1988, awarded 1/3 of the suit land to the objector, 1/3 to the deceased, and 1/3 to a third party. This judgment was never appealed or set aside, and the deceased's attempt to challenge it was out of time. The petitioners, as successors in title to the deceased, are bound by the encumbrances and arrangements entered into by the deceased, including the arbitral award. The revocation of the grant to the objector did not automatically cancel his registration as proprietor, and there was no evidence before the court that such cancellation occurred....

Court Disposition

Protest upheld in part; grant confirmed subject to distribution as per arbitral award and court judgment.
