The court found that a valid Grant of Probate of Written Will had already been issued in respect of the deceased's estate after proper public gazettement and absence of objection. The law does not permit the issuance of two grants for the same estate, as this would create confusion and undermine the administration of justice. Any person, including Richard Momanyi O. Emmanuel, who claims an interest in the estate must pursue their claim within the existing succession cause where the grant was issued. The respondent's petition for a separate grant was therefore both procedurally improper and substantively untenable. The court accordingly struck out the petition with costs to the applicants,...
