Procedural Posture

Succession Cause / Ruling on Application for Revocation of Grant and Related Orders

  1. 1 Whether the grant of Letters of Administration should be revoked and reissued solely to the applicant.
  2. 2 Whether the transfer of estate properties to the administrators before confirmation of grant was lawful.
  3. 3 Whether the 1st Respondent should refund withdrawn estate funds to the estate account.

Ratio Decidendi

The court found that the 1st Respondent had transferred estate assets into the joint names of the administrators before the grant was confirmed, in contravention of Section 55(1) of the Law of Succession Act. The Respondent did not deny the allegations, and his actions amounted to a lack of diligence in administering the estate. The court held that such premature transmission of assets was unlawful and must be reversed to protect the estate from mismanagement and waste. Consequently, the application for revocation of the grant, rectification of the registers, and refund of misappropriated funds was well founded and allowed as prayed.

Court Disposition

Application allowed as prayed.
