Ratio Decidendi

The court found that the applicant, David Muturi Waiganjo, was registered as a trustee for his siblings with respect to a half share in L.R Number Karai/Karai/10949. The evidence, including national identity cards, established that the beneficiaries had attained the age of majority. Since the property had already been sold and the completion of the transfer was contingent upon the discharge of the trustee, the court held that it was appropriate to grant the voluntary discharge. The beneficiaries, now adults, are legally competent to execute the necessary transfer documents jointly with the co-owner, Jane Nyakaro Kamau. The application was therefore merited and allowed.
