Legal Issues
- 1 Whether the consent of the biological parents should be dispensed with due to abandonment of the child.
- 2 Whether the applicants are suitable persons to adopt the minor.
- 3 Whether the child should be presumed a Kenyan citizen by birth.
Ratio Decidendi
The court found that the minor had been abandoned at birth and that all reasonable efforts to trace the biological parents had failed, justifying the dispensation of parental consent. The applicants were found to be suitable adoptive parents based on favorable reports from the Children's Officer and Guardian ad Litem, as well as the court's own observations. The court further held that the child, having been abandoned within Kenya, should be presumed a Kenyan citizen by birth. All statutory requirements for adoption were satisfied, and the adoption was deemed to be in the best interests of the child.
Court Disposition
adoption granted
Orders
- The consent of the biological parents of the minor is dispensed with due to abandonment and failed efforts to trace them.
- The applicants are authorized to adopt the child, who shall henceforth be known as P N G.
