RULING
In the course of writing my decision in this adoption cause, I have discovered that there is conflicting information as regards the background of the adoptive child, K.M.
Whereas the Director of Children’s Services and the police records state that the child was found abandoned by an unknown person at Kisii Village, Industrial area, the Guardian Ad Litem, in her report filed on 1st February 2012 has stated that the child, was born to J.M and D M on 24th November 2008 at K Village in Nairobi.
In view of this serious discrepancy I am unable to make the adoption order at this stage.
The matter is therefore stayed for further clarification and/or appropriate application to correct the anomaly.
