The Supreme Court declined to exercise its advisory opinion jurisdiction because the issues raised were neither novel nor of such public importance as to warrant deviation from the ordinary dispute resolution process. The Court found that the grounds and procedures for removal of a County Assembly Speaker had already been litigated and determined in previous cases, rendering the matter res judicata. The Court emphasized that its advisory opinion jurisdiction is not to be used as an alternative to the appellate process or to resolve issues that are justiciable and fit for trial in lower courts.
