Procedural Posture

Guardianship Petition / Judgment

  1. 1 Whether the subject EWM is suffering from a mental disorder under the Mental Health Act to the extent of being incapable of managing her own affairs.
  2. 2 Whether the petitioners DMK and CGK are suitable persons to be appointed as legal guardians and managers of the subject's estate.

Ratio Decidendi

The court found, based on uncontroverted medical evidence and the testimony of the petitioners and supporting witnesses, that EWM suffers from schizophrenia and is incapable of managing her own affairs or estate. The court was satisfied that the petitioners, who have been primary caregivers and have the support of the subject's children, are suitable to be appointed as legal guardians and managers. The requirements of Section 26 of the Mental Health Act were met, and there was no opposition to the petition. The court therefore allowed the petition and appointed DMK and CGK as legal guardians and managers for EWM with full authority to manage her affairs and estate.
