The court found that the summons for revocation of grant dated 27th January 2004 was not signed by the applicant or his counsel, rendering it incompetent and incapable of being determined. The court further held that the undated summons general filed on 9th January 2004 in HCSC No. 1102 of 1993 had not been prosecuted and was therefore dismissed for want of prosecution. Recognizing the existence of two parallel succession causes relating to the same estate, the court ordered their consolidation, designating HCSC No. 2299 of 2003 as the lead file since the grant in HCSC No. 1102 of 1993 had already been revoked.
