The court found that while some reasons for delay were advanced, a significant period of over 14 months after January 2022 remained unexplained. The applicant failed to demonstrate diligence in following up on the matter, and no affidavit was sworn by the applicant himself to show personal effort. The court held that the confusion and laxity by both the previous and current advocates did not excuse the inordinate delay, and the applicant could not simply blame his advocates without showing his own diligence. The application for extension of time was therefore found to be without merit, and the court declined to exercise its discretion in favour of the applicant.
