Ratio Decidendi

The ex parte judgment entered against the 3rd Defendant was irregular because there was no service of summons to enter appearance upon her. The only attempt at service was on a co-defendant, which is insufficient. In cases of irregular judgment due to lack of service, the court is bound to set aside the judgment ex debito justitiae, without the need for discretion. Consequently, the ex parte judgment and all consequential orders against the 3rd Defendant are set aside, and she is granted unconditional leave to defend the suit. The 3rd Defendant is ordered to file and serve a Memorandum of Appearance and defence within 15 days. Costs of the application are to be in the cause.
