Ratio Decidendi

The court found that since the application for stay of execution before the Court of Appeal had been dismissed, the stay order previously granted by this court automatically lapsed. As a result, there was no longer any basis to review or vary the order requiring deposit of funds in a joint account or to substitute it with a deposit into court. The parties reverted to their positions prior to the stay, and the defendant was at liberty to execute the decree. The plaintiff's application to vary the deposit order was therefore dismissed as moot, and each party was ordered to bear their own costs.
