The court found that the quashing of the Certificate of Surcharge No. 141 of 2010 by the Judicial Review Court constituted new and important evidence that was not available at the time of the previous ruling. Since the Plaintiff's suit was predicated on the existence of the certificate, its nullification removed the basis for the claim. Section 24 of the State Corporations Act makes the certificate conclusive evidence of the sum due, and without it, the Plaintiff's case could not proceed. The court rejected the Plaintiff's argument that other documentary evidence could sustain the suit, holding that the statutory scheme required the certificate as a prerequisite.
