The bank was entitled to legal costs incurred in defending the suit, as stipulated in the contractual agreement (clause 8.3 of the letter of offer). The plaintiff was therefore obliged to pay these costs on an indemnity basis. The court declined to dismiss the suit for want of prosecution, instead marking the suit as settled on the terms that the bank would release the title documents upon payment of the specified legal costs and assessed suit costs.
