Ratio Decidendi

The court found that although the insurance policy contained an arbitration clause, the 1st Defendant had already filed a defence and conceded to the court's jurisdiction. Under Section 6 of the Arbitration Act and established case law, a party wishing to invoke an arbitration clause must do so before filing a defence. By failing to apply for a stay and referral to arbitration at the appropriate stage, the 1st Defendant lost the right to rely on the arbitration clause. The court therefore retained jurisdiction to hear the matter, and the preliminary objection was dismissed.
