Ratio Decidendi

The Court of Appeal held that the Fourth Schedule to the Auctioneers Act does not permit cumulative charging of auctioneer's fees across different bands. The correct approach is for the auctioneer to identify the reserve price and apply the percentage rate applicable to the band in which the reserve price falls. Allowing cumulative charging would defeat the purpose of the banded structure, result in unjust enrichment, and amount to double charging. The Court rejected the appellant's reliance on Alimex Limited v Startruck Auctioneers, finding that the High Court in that case erred in principle. The appeal was dismissed, and the trial court's interpretation was affirmed.
