There was no evidence of notice to the union or labour officer, nor was there evidence of a fair selection process or valid justification for the redundancy. The court held that the redundancy was both substantively and procedurally unfair. Although the claimant had received his terminal dues, the court awarded him five months' salary as compensation for unfair termination, plus costs and interest, and ordered that a certificate of service be issued within 14 days.
