Procedural Posture

Environment and Land Case / Judgment

  1. 1 Whether the defendants have proved their counterclaim of adverse possession over portions of L.R. SAMIA/BUTABONA/89 or its subdivisions.
  2. 2 Whether the plaintiff has established a case for eviction of the defendants from L.R. SAMIA/BUTABONA/2705.
  3. 3 Whether a customary trust existed in favour of the defendants over the suit land.

Court Disposition

Plaintiff's suit dismissed; defendants' counterclaim allowed in part.
