Ratio Decidendi

The court determined that the question of whether Title No. Iriaini/Kairia/1865 and related parcels form part of the deceased's estate is central to the succession proceedings and should be conclusively resolved at the hearing of the protest and the summons for confirmation of grant. In the interim, to prevent frustration of the court's eventual judgment and to preserve the subject matter of the dispute, the court found it necessary to issue a prohibitory order restraining any dealings with the disputed properties. The application for such orders was therefore allowed, with costs to abide the outcome of the confirmation proceedings.
