The deceased's widow and son, lacking confirmed grant of representation at the time, had no legal capacity to sell or transfer any interest in the property to Musembi or, by extension, to the appellants. The appellants' acquisition and registration of the property was therefore tainted with illegality and incapable of conferring valid title.
