The court found that although the plaintiffs/applicants demonstrated long-term occupation and a prima facie case regarding their interest in the suit property, the application was fatally defective for failure to join all co-administrators of the deceased's estate, as required by Order 31 Rule 2 of the Civil Procedure Rules and Section 82 of the Law of Succession Act. The mandatory nature of these provisions means the court cannot entertain the application in the absence of all administrators as parties. The court therefore struck out the application for non-joinder, without addressing the substantive merits of the injunctive relief sought.
