Procedural Posture

Succession Cause / Ruling on Summons for Revocation of Grant

  1. 1 Whether the grant of letters of administration was obtained fraudulently by concealment of material facts.
  2. 2 Whether all assets and beneficiaries of the deceased were disclosed in the petition for grant.
  3. 3 Whether the confirmed grant should be revoked due to non-disclosure and improper distribution of the estate.

Ratio Decidendi

The court found that the respondents failed to disclose all the deceased's properties and beneficiaries in the petition for grant, constituting non-disclosure of material facts. The fact that the deceased may have distributed his properties during his lifetime did not relieve the administrators of their duty to make full disclosure to the court. The omission of two parcels of land and failure to list all beneficiaries rendered the grant defective. Consequently, the court revoked the confirmed grant to allow for a fresh application that incorporates all properties and beneficiaries, ensuring a fair and lawful distribution of the estate in accordance with the Law of Succession Act.

Court Disposition

confirmed grant revoked; fresh application for confirmation of grant to be filed
